Terms of Use of the DTM Livestreams of ITR GmbH

The content of DTM Livestream is protected by copyright. The duplication, modification, recomposition, republication, distribution or storage of information or data, in particular of videos, texts, text parts or graphical material requires the prior written consent of ITR GmbH. The DTM Livestream may only be used for private, non-commercial purposes in compliance with the copyright law. The DTM logo and DTM brand are subject to the trademark rights of ITR and may not be used without the written consent of ITR. The sale and use for advertising purposes are prohibited.

1. Access to the DTM Livestream

The streaming platform “DTM Grid” is an interactive online service and is operated by ITR GmbH, Epplestr. 225, 70567 Stuttgart, Germany (hereinafter referred to as “ITR”). For the use of “DTM Grid”, the following terms of use shall apply exclusively to the user. The use of “DTM Grid” requires the agreement of the terms of use and the privacy policy.

In order to use the service, the user must be registered. Access is possible with internet access only, therefore additional costs may arise for the user through the use of internet access. ITR reserves the right to change the terms of use.

2. Costs for use of DTM Livestream

At present the use of the DTM Livestream is generally free of charge. ITR reserves the right to change the existing business model at any time and to charge a fee for individual contents, channels or the entire service portfolio. ITR will then explicitly highlight these respective chargeable contents, including the scope of service, terms and fees including VAT.

3. Limitation of liability of ITR

ITR does not guarantee that the DTM Livestream and content are free from any irregularities, errors or bugs or that it is working uninterruptible. In this regard, ITR can freely determine in which periods the DTM Livestream and contents are not available for technical reasons, for reasons of improvement of the offered services or optimization of their handling.

Nor can ITR be held liable for any damages resulting from the use of the Website, their contents and the Internet, such as loss of data, external intrusion into the computer system, virus infestation or other involuntary problems, unless it has been proven that ITR has failed to fulfill its obligation to ensure data security by appropriate means. Under no circumstances ITR can be held liable for any damage caused by force majeure.

4. General Regulations

The law of the Federal Republic of Germany applies.
